Buying or selling a home shouldn’t feel like a gamble. The Government wants to change that. 

Buying or selling a home is meant to be exciting. For a lot of people, it turns into one of the most stressful things they’ll ever do. 

You know the pattern. A buyer finds a property, agrees a price, gets the mortgage moving, pays out for legal work, and waits. A seller accepts an offer, starts making plans, maybe even finds their next place. Then weeks or months in, it falls apart. 

A buyer pulls out. A seller has second thoughts. Something ugly turns up in the paperwork. The chain snaps. Or a better offer swoops in at the last minute. 

It’s frustrating. It’s expensive. And for a lot of people, it’s genuinely upsetting. 

That’s exactly why the Government’s proposed reforms1 to home buying and selling in England and Wales matter. The goal is a faster, clearer system with more certainty, so fewer deals collapse after buyers and sellers have already put in the time and the money. 

Get the full picture before the property even goes on the market 

One of the biggest changes on the table is giving buyers more information upfront, before an offer is even made. 

Right now, a lot of the important stuff only comes out after an offer has been accepted. Things like the condition of the property, leasehold costs, service charges, ground rent, building work, guarantees, and whether the seller is stuck in a chain. 

Under the new proposals, sellers and estate agents would need to have more of this ready from day one. 

For buyers, that means going into an offer with your eyes open instead of finding out the awkward stuff three weeks later. For sellers, it means getting your paperwork sorted before the property goes live, not scrambling for it once you’ve got an interested buyer. 

Fewer nasty surprises further down the line. That’s the theory, and it’s a good one. 

Making agreements actually mean something, earlier 

The second big proposal is earlier binding agreements between buyers and sellers. 

At the moment, an accepted offer in England and Wales isn’t legally binding. Either side can walk away right up until exchange of contracts. That leaves both parties exposed. 

A buyer might have already paid for a survey, a solicitor and mortgage arrangement work, only for the seller to accept someone else’s offer instead. A seller might take their home off the market and turn other buyers away, only for their buyer to pull out. 

The Government wants to build in more commitment, earlier. There will need to be room for genuine problems, a bad survey, a legal defect, a change in lending circumstances, but the intention is clear: fewer people getting messed about at the last minute, and more confidence once a sale is agreed. 

Dragging the paperwork into the digital age 

Anyone who’s been through a house move knows how slow the paperwork can be. Documents pass between estate agents, solicitors, lenders, surveyors, local authoritiesand everyone in between. The same information gets requested more than once, checked by hand, chased up again and again. 

The proposed reforms push towards better digital property information, digital identity checks, electronic signatures and improved data sharing between everyone involved in the transaction. 

It sounds like a back office issue, but it’s not. If information moves faster and more securely between the right people, transactions are easier to track and less likely to stall because of missing or duplicated paperwork. 

Raising the bar for estate agents 

The Government is also looking at professional standards across the estate agency sector, including a code of practice and mandatory qualifications for agents. 

Plenty of estate agents already do a good job. This is about consistency across the board. For buyers and sellers, that should mean clearer expectations, better communication, and a more professional standard of service throughout. 

When you’re dealing with one of the biggest financial transactions of your life, the people managing it for you matter. A lot. 

What happens next 

These reforms are a genuinely positive step, but nothing changes overnight. Some elements will land sooner than others, and the bigger structural changes will take time to bed in properly. 

In the meantime, buyers and sellers still need to work within the current system, so getting the right advice and the right team around you still counts for everything.
