Yes Mortgage Services Limited Data Privacy Policy
How we will handle your personal data and protect your privacy
A guide to how we meet the requirements of UK Data Protection Legislation.
Making sure personal data is secure and properly dealt with is of paramount importance in our dealings with you. It is therefore important you understand what information we will take, why we need it, and how we will process your details.
Who will process my data?
Yes Mortgage Services Limited (trading as Yes Mortgage Services) is an Appointed Representative of HL Partnership Limited, which is authorised and regulated by the Financial Conduct Authority. Both Yes Mortgage Services and HL Partnership Limited act as Data Controllers and will process your data to provide our services.
What data will you ask me for?
To provide suitable mortgage and protection advice, we collect information about your identity, family, personal circumstances, and preferences. This includes sensitive “Special Category” data such as income/expenditure, health (for insurance purposes), and credit commitments. This information is shared with lenders and providers as part of your application process.
Do I have to provide my personal data?
Yes. To provide advice that meets regulatory standards, we require open and honest disclosure. If you choose not to disclose certain information, we will assess whether this prevents us from proceeding with your application.
How will you use my data?
We process your data under the following legal bases:
- Contractual Necessity: To assess, provide advice, and administer your mortgage or insurance applications.
- Legal & Regulatory Obligation: To comply with FCA regulations and prevent financial crimes (Money Laundering/Fraud) via agencies like the NCA.
- Legitimate Interests: For business analysis, quality assurance reviews, and to exercise or defend legal claims.
How long will we store your data?
We retain personal information only as long as necessary. Due to our regulatory obligations to provide evidence of past advice, mortgage records are generally stored for an indefinite period.
Your Data Rights
- Right of Access: You may request a copy of the personal data we hold. We will provide this within one calendar month, subject to identity verification.
- Right to Rectification: You have the right to correct inaccurate data. Note that we must maintain a record of the information as it stood at the time of advice.
- Right to Erasure: In most mortgage cases, we cannot erase your data because we are legally required to maintain records for regulatory and indemnity purposes.
